Mmkay, translation time: The article states that a town in Michigan has passed an ordnance that can have people who are annoying get fined by the cops. Way too much potential for abuse here.

Being Annoying Now Illegal In Brighton

POSTED: Friday, December 19, 2008
UPDATED: 4:46 pm EST December 22, 2008
BRIGHTON, Mich. -- Since when did being annoying become a crime? Since Brighton City Council approved a public conduct code Monday night, which includes fining someone up to $500 for being annoying.

One section of the bill reads, "It shall be unlawful for a person to engage in a course of conduct or repeatedly commit acts that alarm or seriously annoy another person and that serve no legitimate purpose."

The bill also states it's unlawful for anyone to insult, accost, molest or otherwise annoy any person in public.

The ordinance was modeled after one in Royal Oak, where the Brighton police chief previously worked.

The Livingston Daily Press & Argus reported that two council members expressed concerns for the language of the ordinance, but voted for it anyway.

Brighton officials said the ordinance would be subjective and the call will be made by police officers.

The amended ordinance takes effect Jan. 17, 2009.

sounds pretty effin cool, but I can see it getting shot down by Supreme Court the very first time that someone appeals it to that level. of course, I can see myself pressing charges against the state for that one.

What if someone went up to a friend in public and started barking at them? Would they be fined for that in that area?

If this includes in schools and they bring it in my area in Trashford! Then I'm not going to be happy :( I'll be fined everyday for barking at my friends LOL! :(

That's ridiculous and subjective. How could you find proof that the person was annoying, and how could you find proof tat you wren't. This would be court's worst nightmare...

Just another step close to not being able to do anything you want in the near future. It'll be like NO dont eat that! its not exactly dinner time. If this post made sense to anyone like! lol

EDIT: isn't it funny tho, they're trying to stop people being annoying but yet they're annoying themselves?

Guess I better stop annoying the cops then. They'll take into account this new "rule".

That, or I'll continue playing mind games with them and tell them they are annoying me by fining me. Are they allowed to annoy and we're not?

I actually live less than an hour away from Brighton & I think Annoyance being against the law is a good thing, because it will at least grow a much more mature population.

Lew

This may seem rather trivial, but by studying law (english that is, not american), little things like this are important in establishing real crimes. I.e it is rare and pointless for someone to be charged of an assault or battery, as they are barely even crimes in themselves, but they are vital in estbalishing the actus reus (basically all the elements of the crime other than the defendant's state of mind) of Actual bodily harm.

Why this annoying behaviour wouldn't just constitute to assault (or battery if erm poking is involved :p) is beyond me though...
