Saddam’s lawyer Saadoun Nasouaf al-Janabi was found dead one hour after being abducted by ten armed men that invaded his office on Thursday night. However, given that the murder was not announced until today, Interior Ministry sources said the body was discovered Friday noon. Mr Janabi was acting for one of Saddam Hussein’s co-defendants, Awad Hamed al-Bandar, a former top judge. His abduction triggered the outrage of his colleagues. Badi Aref Izzat, former Iraqi government vice president Tariq Aziz’s lawyer, described the abduction as "scandalous," while he accused the American army of not protecting those participating in the trial.



Climate of Fear


"If we cannot protect the lawyers, how can our clients be protected and how will witnesses dare to show themselves in court?" wondered Badi Aref Izzat, adding that the incident will not stop him from proceeding with his mission.

"Iraq is under the protection of the US army and we accuse it for this tragic incident. As per the Geneva Convention, the occupying force is obliged to defend the citizens of the occupied country," said Saddam Hussein's lawyer Khalil Dulaimi on television network al Jazeera.


Dulaimi added that the incident aimed at creating a climate of fear for the lawyers defending the members of a legitimate leadership, stressing that threats against Saddam's lawyers are continuous.

This isn't a new situation unfortunalely :( ... An Afghan detainee in Canada had a lawyer who quit the case after he recieved threats on the phone.

Wonder if Laws in this case can ever be upheld. Saddam may be a mass murderer but like everyone, he deserves a trial. The law is the law.

thats the idea of democracy. that everyone have the right to have a lawyer and a fair trial. i didnt think i would say this, but an attack against saddam himself, his lawyer, family or friends is an attack agianst democracy.

If he goes to prison according to the law, it would be good, since he stepped over the law to do his stuff. Doing the same as he did, would lower them.

Of course they would do their job for me if I needed one...does that mean I still have to like em? For as much as they screw you out of, they better raise my kids too.

And who are you to say who does and does not deserve legal representation?

Yes you are completely right Draco. My reaction was emotionally coloured because i have advacates amongst my friends. I know that they do a very integer job to help people, also many 'pro-deo' cases.
I also am aware that there exist advocates who coldheartedly can set free true criminals by proving the justice system made mistakes (often enough reason to win a case).
I also know their wages per hour. It is a very lucrative profession. But their knowledge and efforts are enormous and can save people from being jailed innocent or totally ruined financially.

You are also right: "who am i to judge who deserves one" I don't have that right. I am just ****ing mad when monstruous killers and genocidal dictators get treated with justice. But of course in our legal system (and we want that) everybody deserves that chance because we agreed we don't treat them at their own low level. When evidence is very clear the role of the advocate still remians to make sure that the punishment is in accordance to the law.

When Ceaucescu and his wife were executed after a few hours 'trial', i could fully understand the people's relief out of revenge. However i was repulsed by the pictures (fear of death in their faces) because i can never condone any human be placed in the situation of being refused defense and robbed of any chance to survive. But in the end: they never cared when they did the same themselves to their victims. The games Pinochet's protectors played with international justice while thousands of the victims's relatives cry for justice is sickening to me also.

But it is correct: All or none. Period.
