Toby guard only designed Lara's look, not Lara the character. But now she's completely redesigned so if that's the case, how does he still have the copyright?

He "created her name" or something so somehow has to get right by law or something. It's the same with movies the Wayans Brother's recieve writing credits on all four Scary Movie films even know they only made the first two but they still had to be credited as writers for the characters in the movie. It's complicated but it's just so things remain legal. Toby wasn't involved with any of the Core games since Tomb Raider 2 and he still had to get a character writing credit on them. :)

Well that's pretty much because Lara from tr1 up until now was very similar. But I don't even think Toby created the name either. The core team was flipping through a phone directory or something like that.
